These Terms of Service (“Terms”) apply to the use of the Fixote online store and to all purchases made via the website https://fixote.com (the “Site”).
The Site is operated by Sphere3D OÜ, registry code 16430990, registered in Estonia.

By accessing or using our Site, or by placing an order, you agree to be bound by these Terms. If you do not agree with the Terms, you should not use this Site.


1. Definitions

  • “We”, “us”, “our” – Sphere3D OÜ operating the Fixote online store.
  • “You”, “customer”, “buyer” – any person or entity using the Site or placing an order.
  • “Products” – goods offered for sale on the Site, mainly used and new electronics and accessories.

2. Online store terms

2.1. You must be at least 18 years old or have legal permission from your parent/guardian to place orders on this Site.
2.2. You agree not to use our products for any illegal or unauthorized purpose and not to violate any laws in your jurisdiction.


3. Products, condition and availability

3.1. We specialize mainly in used and pre-owned electronics. Product pages state the key technical specifications and condition as accurately as possible, including visible signs of wear when applicable.
3.2. Product images are illustrative. Minor differences in colour or small cosmetic details may occur due to lighting or screen settings. These do not affect the functionality of the product and are not considered defects.
3.3. All products are offered subject to availability. We reserve the right to limit quantities of any products, to discontinue any product at any time, or to cancel orders if the product is not available.
3.4. If an ordered product is unavailable after payment, we will inform you as soon as possible and offer a replacement, store credit or a full refund.


4. Prices and payment

4.1. All prices on the Site are shown in euros (EUR).
4.2. Sphere3D OÜ is currently not VAT registered; therefore, VAT is not added to the prices. If our VAT status changes, this will be reflected on the Site and in invoices.
4.3. We reserve the right to change prices at any time. The price applicable to your order is the price displayed at checkout at the moment you confirm and pay for the order.
4.4. We accept the payment methods displayed at checkout (such as bank cards, online payments, etc.). Payment must be completed in full before the order is processed and shipped.
4.5. If your payment is reversed, charged back or not received, we may cancel or suspend your order.


5. Ordering process and contract

5.1. By placing an order on the Site, you make an offer to purchase the selected products according to these Terms.
5.2. After you place an order, you will receive an order confirmation email. This confirms that we have received your order, but it does not yet mean that a contract is concluded.
5.3. The purchase contract between you and Sphere3D OÜ is considered concluded when we send a separate email confirming that your order has been shipped or is ready for pickup.
5.4. We reserve the right to refuse or cancel any order, for example in cases of:

  • obvious pricing errors;
  • product unavailability;
  • suspicion of fraud or misuse;
  • incorrect customer information.

If your order is cancelled after payment, we will refund the full amount paid.


6. Shipping and delivery

6.1. We currently ship orders from Estonia to European Union countries using Omniva, DPD and Itella Smartpost.
6.2. Processing time is usually 1–3 business days after payment is received.
6.3. Estimated delivery times after dispatch:

  • Estonia: 2–3 business days
  • European Union: 3–10 business days

6.4. Shipping rates:

  • Estonia: 5 €
  • European Union: 10 €
    There is currently no free shipping limit.

6.5. Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, holidays or other circumstances beyond our control.

7. Customs duties and import taxes

7.1. Orders shipped outside the European Union may be subject to customs duties, import taxes and other fees charged by local authorities.
7.2. These charges are not included in our prices or shipping costs and are the responsibility of the customer.


8. Right of withdrawal, returns and refunds

8.1. If you are a consumer residing in the EU, you generally have the right to withdraw from the purchase contract within 14 days without giving any reason, in accordance with applicable consumer protection laws.
8.2. The withdrawal period starts from the day you receive the product.
8.3. To exercise your right of withdrawal, you must clearly inform us (for example, via email) within the 14-day period and return the product in accordance with our instructions.
8.4. Returned products must be in the same condition as received, including all accessories, cables and packaging where reasonably possible.
8.5. We may reduce the refund amount if the product has been used more than necessary to determine its nature, characteristics and functioning, or if it is returned incomplete or damaged.
8.6. In case of justified withdrawal or approved return, we will refund payments within a reasonable time after receiving the returned goods. Refunds are usually issued using the same payment method that you used for the original transaction.

8.7. Detailed rules, including who pays for return shipping and any exceptions (for example, for specially customized items), are described in our Return and refund policy, which forms part of these Terms.


9. Warranty and defects

9.1. Used electronics may show normal signs of previous use. Such cosmetic wear that is clearly described in the product listing is not considered a defect.
9.2. We test products before sale. If a product turns out to be defective or does not match the description, please contact us as soon as possible with your order number and a description of the issue.
9.3. Consumers in the EU may have statutory rights regarding defective goods. Nothing in these Terms is intended to limit those mandatory rights.


10. Accounts and customer information

10.1. You are responsible for providing accurate, complete and up-to-date information when placing an order or creating an account.
10.2. You are responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account.
10.3. We reserve the right to suspend or terminate accounts that are used in violation of these Terms or applicable law.


11. Personal data and privacy

11.1. We collect and process personal data in accordance with our Privacy policy, which explains what data we collect, how we use it, and your rights as a data subject.
11.2. By using this Site, you agree to the processing of your personal data as described in the Privacy policy.


12. Prohibited uses

You are prohibited from using the Site or our products:

  • for any unlawful purpose;
  • to violate any international, EU or local regulations, rules or laws;
  • to infringe upon or violate our intellectual property rights or the rights of others;
  • to upload or transmit viruses or any other malicious code;
  • to collect or track the personal information of others;
  • to spam, phish, crawl or scrape the Site;
  • to interfere with or circumvent the security features of the Site or related services.

We reserve the right to terminate your use of the Site or services for violating any of the prohibited uses.


13. Third-party services and links

13.1. Our Site may contain links to third-party websites or use third-party tools (such as payment providers or shipping partners).
13.2. We are not responsible for the content, accuracy or policies of such third-party websites or services. Your use of them is at your own risk and governed by the terms and policies of those third parties.


14. Limitation of liability

14.1. To the maximum extent permitted by law, Sphere3D OÜ shall not be liable for any indirect, incidental, special or consequential damages, including loss of profit, data or business opportunities, arising from the use of the Site or products purchased from it.
14.2. Our total liability for any claim related to a product or these Terms is limited to the amount actually paid by you for that product.
14.3. Nothing in these Terms limits our liability for intent, gross negligence or any other liability that cannot be excluded under applicable law.


15. Changes to the Site and prices

15.1. We may modify or discontinue the Site (or any part of it) at any time without prior notice.
15.2. We may change product prices, shipping fees and these Terms from time to time. The version of the Terms applicable to your order is the one in force at the time you place the order.


16. Changes to these Terms

16.1. The latest version of the Terms is always available on this page.
16.2. We reserve the right to update, change or replace any part of these Terms by posting updates on the Site.
16.3. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.


17. Governing law and dispute resolution

17.1. These Terms and any contracts concluded via the Site are governed by the laws of the Republic of Estonia, without regard to conflict of law principles, unless mandatory consumer protection laws of your country of residence provide otherwise.
17.2. In case of a dispute, you should first contact us so we can try to resolve the issue amicably.
17.3. If an agreement cannot be reached, disputes will be handled by the competent courts of Estonia. Consumers may also have the right to turn to alternative dispute resolution bodies or online dispute resolution platforms as provided by EU law.
